You have made the difficult decision to end your marriage or long-term relationship. Whether married or cohabitating, you may have children to consider. Perhaps you have debts and assets to divide. You may be concerned about issues of child support or spousal support. You may wonder if some of your assets belong to you alone and if your spouse has an interest. Assets you are worrying about may include the family home, the vacation home, bank accounts, RRSPs, pensions, and business assets if you are self-employed. You may still be living together and contemplating an amicable separation or you may have already moved out and need to find a new way forward. Before you can do that, you need to know what your rights are, what the rights of your spouse are, and how best to look after yourself and your family right now.

Continued care, co-parenting and maintenance of children are often the most difficult issues you will face. Guardianship, custody and access, parental responsibilities, parenting time and agreed-upon necessary contact to facilitate co-parenting all need to be worked out. Child support needs to be determined by the Federal Child Support Guidelines. This requires an accurate assessment of income and added special expenses such as daycare, medical or dental expenses, and activity/educational expenses which should be shared.
We can assess your particular situation, whether these financial and child care issues can be agreed upon, or whether litigation will be needed. Often these issues can be worked out by negotiating a Separation Agreement. Mediation and other forms of alternative dispute resolution may be suitable for your case. If there are family violence concerns, you may need quick access to the court for immediate orders. If things cannot be resolved, you may need an experienced trial lawyer to represent your interests in the Supreme Court. We provide all of these services to you.
Christopher York specializes in the litigation aspect of your family law problem. We ensure that your legal team reflects your needs and your individual situation by offering both litigation and mediation/alternative dispute resolution services.
